These Terms govern use of the Chabeel Finder application (“the App”), provided by Atlantic IT Services (ABN 29 892 371 842) (“the Operator”, “we”, “us”, “our”) — a sole trader based in Victoria, Australia. By ticking the agreement checkbox when you first open the App, you accept these Terms and the Privacy Policy, which forms part of these Terms.
1. What Chabeel Finder is
Chabeel Finder is a free, community-driven app for locating active Chabeel stations — places where free drinks and food are distributed as an act of Seva (selfless service) rooted in the Sikh tradition. The App is open to everyone, regardless of background or faith. It is not a commercial marketplace, delivery service, or booking platform, and no payment ever changes hands through the App.
2. No accounts
The App has no sign-up, login, or user profiles. It identifies your device with an anonymous, randomly generated ID so you can manage pins you've added and so the community-reporting system works fairly. You don't need to give us your name, email, or phone number to use the App.
3. Acceptable use
You agree not to:
- Add a pin for a location that isn't a genuine, currently active Chabeel — including locations that don't exist, have already ended, or are intended to mislead others.
- Submit false reports, or use the reporting system to target a legitimate pin out of spite rather than to flag a real problem.
- Attempt to bypass the App's rate limits, security rules, or content checks, including by automated means (scripts, bots).
- Use the App's free-text note field to submit anything unlawful, abusive, hateful, or that infringes someone else's rights.
- Reverse-engineer, decompile, or extract the App's source code, except to the limited extent this restriction cannot lawfully be prevented.
We have zero tolerance for objectionable content or abusive users. Notes are automatically filtered for profanity, links and contact details, and any user can report a pin as offensive, which removes its note immediately. We review flagged content within 24 hours, and may remove content or block a device's access to the App for a breach of these Terms.
You can also block any contributor from the menu on their pin. Blocking hides every pin from that contributor on your device.
4. Content you submit
Anything you submit — a pin's location, items, and note, or a report — is public: it's shown to every person using the App, because that's the App's purpose. By submitting it, you confirm it's accurate to the best of your knowledge and you grant us a licence to store, display, and distribute it within the App for as long as it's needed to operate the service (see the Privacy Policy's retention section). You don't own any special right to have it kept beyond that period, and we may remove it at any time if it breaches these Terms, is reported and confirmed inaccurate by the community, or expires under the App's normal 4-to-24-hour pin lifecycle.
5. No warranties — verify before you travel
Chabeel pins are added by members of the public, not verified by us before they appear. The App is provided "as is" and "as available", and we do not guarantee that any pin is accurate, currently active, or safe to visit. Always exercise your own judgement, and don't rely solely on the App before travelling to a location.
6. Third-party services
The App relies on services outside our control, including Google Firebase (hosting, database, authentication, crash reporting, app-integrity checks), Google AdMob and the User Messaging Platform (advertising and consent), and Mapbox (map rendering). To the maximum extent the law allows, we are not responsible for the availability, accuracy, or acts or omissions of these third-party services.
7. Advertising
The App shows a single banner ad, shown only after your ad-consent choice (and, on iOS, your App Tracking Transparency choice) has been resolved, as described in the Privacy Policy. There are no interstitial, rewarded, or in-app-purchase features in the App.
8. Availability and changes to the App
We aim to keep the App available but don't guarantee uninterrupted or error-free operation — it depends on your device, your internet connection, and the third-party services in section 6. We may add, change, or remove features, or discontinue the App entirely, at any time. Because the App is free with no subscription or prepaid fee, discontinuing it doesn't give rise to any refund obligation.
9. Intellectual property
The App itself — its software, design, and branding — is owned by the Operator or its licensors. You receive a non-exclusive, non-transferable, revocable licence to use it for its intended purpose. Content you submit remains subject to the licence you grant us under section 4.
10. Consumer guarantees and liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the ACL that cannot lawfully be excluded.
Otherwise, to the maximum extent the law allows: the App is provided without warranty of accuracy, completeness, or fitness for a particular purpose; we are not liable for indirect, incidental, or consequential loss (including loss arising from relying on inaccurate pin information); and because the App is provided free of charge, our total aggregate liability to you for any claim is capped at AUD $50.
11. Termination
You can stop using the App at any time simply by uninstalling it. We may restrict or block a device's access to the App if we reasonably believe these Terms have been breached, without needing to identify who is behind the device (since the App has no accounts).
12. Changes to these Terms
We may update these Terms as the App or the law changes. Where a change is material, we'll notify you in the App and, where appropriate, ask you to re-acknowledge it before continuing. If you don't accept a material change, your remedy is to stop using the App.
13. Dispute resolution
If a dispute arises, we'll both first try in good faith to resolve it by discussion. If it isn't resolved within 21 days of one of us raising it in writing, either of us may pursue mediation or take the matter to the courts. Nothing in this clause prevents either of us from seeking urgent relief from a court where needed.
14. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the App.
- Severability. If any part of these Terms is invalid or unenforceable, it's read down or severed to the minimum extent needed, and the rest continues to apply.
- No waiver. If we don't enforce a right straight away, that isn't a waiver of it.
- Force majeure. Neither of us is liable for a failure or delay caused by something genuinely beyond our reasonable control.
- No third-party rights. These Terms are between you and us; no other person may enforce them.
15. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and the Operator submit to the exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.
